City-RR easement deal for overpass tops council agenda |

A resolution authorizing Mayor Rick Holland to enter into an agreement with Union Pacific Railroad to acquire an easement for the Arkansas 35 overpass is on the agenda for the Benton City Council’s meeting tonight at Benton Municipal Complex. The council session is scheduled for 7 and is open to the public as are all council meetings and council committee sessions. The resolution regarding the overpass states that the construction of the overpass is necessary for the safe and continuous flow of traffic along that highway. It notes that Union Pacific has prepared an agreement to acquire the easement necessary to build the overpass. The document outlines the railroad company and the city’s responsibilities with respect to the construction project. The agreement, titled “New Public Road Crossing Overpass Agreement,”authorizes the mayor to pay $6,924 as compensation to Union Pacific for the easement and any additional funds determined to be necessary for the project. The council agenda also includes other ordinances and resolutions, including a resolution that levys an annual tax on real and personal property for city general and other purposes as required by law. An ordinance on the agenda amends a previous ordinance regarding restriction on the amount of acreage necessary in certain areas of the city for the purposes of development.
Other items on the council agenda are: •An amendment to a lease agreement with the Arkansas Game and Fish Commission. •An ordinance amending a previous one that set the terms of the Civil Service Commission members. •Two rezoning ordinances. •A resolution acknowledging the property on the Lake Norrell landing as a city park under the administration and maintenance of the Benton Parks Commission. •Resolutions condemning structures. The locations are 816 S. Market, 1511 Cedar St., 1517 Cedar St., 3111 Edison Ave., 3119 Edison Ave. and 3115 Edison Ave. The condemnation ordinances are being recommended by Alderman Steve Lee, chairman of the council’s Health and Safety Committee. In addition to the stated agenda items, reports are possible from the chairmen of standing council committees. Those panels and their chairmen are: •Streets, Alderman David Sparks. •Utilities, Alderman Jerry ponder. •Personnel, Alderman Brad Moore. •Animal Control, Alderman Larry Wolf. •Advertising and Promotion Commission, Alderman Moore.
